These Terms and Conditions (the “Terms”) govern the “The Level Up” contest (the “Contest”) offered by Class 4 Kids Ltd. (“ClassForKids”), a UK company. By participating, contestants acknowledge and agree to be bound by: (i) these Terms, which are subject to amendment by ClassForKids; (ii) if selected as a Winner (as defined herein), and on acceptance of a Prize (as defined herein), the Prize Terms (as defined herein); and (iii) and the decisions of ClassForKids, which are final.

Eligibility and Entry

1.1 Entry is open to individuals 18 years of age or older (or older age of majority required by the laws of the jurisdiction of residence of the contestant) who have entered online to participate in ClassForKids’ The Level Up contest (each, a “Contestant”).

1.2 Entry is open to Contestants from 11:00 am GMT on January 29, 2024, until 11:59 pm GMT on February 29, 2024 (the “Contest Entry Period”).

1.3 To enter the Contest, Contestants must complete and submit the Contest submission form on this WEBSITE, to the satisfaction of ClassForKids in its sole discretion, within the Contest Entry Period.

1.4 No purchase is necessary. Multiple entries are allowed, provided a Contestant cannot nominate the same business in more than one entry. A Contestant may only enter the Contest if the Contest does not breach any law or regulation of the jurisdiction in which they are resident. Void where prohibited by law. Contestants are solely responsible for determining whether the Contest breaches any law or regulation of the jurisdiction in which they are resident.

1.5 Entries must not, in the sole and unfettered discretion of ClassForKids, contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content, content containing unsolicited commercial messages (spam), or content that infringes on the intellectual property rights of a person.

1.6 The Contest is not open to employees of ClassForKids or its affiliated companies or their immediate families, or to anyone professionally connected with the Contest. ClassForKids reserves the right to review the eligibility of the potential Winners before a Prize is awarded.

1.7 ClassForKids accepts no responsibility for late entries or entries not received for any reason.

1.8 The Contest is only open to individuals resident in the United Kingdom and the Republic of Ireland. ClassForKids reserves the right to review the eligibility of each of the Winners before a Prize is awarded.

1.9 All entries become the property of ClassForKids.

Prize

2.1 One Grand prize (a “Grand Prize”) consists of:

2.1.1 £500 budget for Facebook advertising.

2.1.2 Logo redesign with Jack Chitty, a freelance logo & brand identity designer.

2.1.3 Creation of a Brand guidelines document Jack Chitty, a freelance logo & brand identity designer

2.1.4 A 1-hour session with Jack Chitty, a freelance logo & brand identity designer. This will be done via a Google Meet video call.

2.1.5 A 1-hour Workshop with a graphic designer to learn how to use brand assets. This will be done via a Google Meet video call.

2.1.6 Annual subscription to Canva Pro, a user-friendly graphic design platform.

2.1.7 5 branded social media templates to use for future social posts.  

2.1.8 A 15-second ad to use for brand awareness or advertising (from idea to finished video).

2.1.9 Two x 1 hour sessions with panelist Libby Langley.

2.1.10 Company audit by an experienced industry business professional relevant to the Contest winner & 3 x 1-hour sessions to discuss growth, development, answer questions, work on future plans. This will be done via a Google Meet video call.

2.1.11 Marketing audit by ClassForKids’ Head of marketing & a 1-hour session to plan the brand growth, opportunities, social media presence and prepare a plan for the future. This will be done via a Google Meet video call.

2.1.12 2 x 1-hour sessions with the Facebook ads experts to discuss advertising opportunities and put a plan in place to grow the club. This will be done via a Google Meet video call.

2.1.13 An hour session with ClassForKids Founder Nikki to hear his story and take away inspiration for your own business.

2.2 Each Prize is non-transferable and no cash, currency conversion or other substitution of a Prize is permitted, except at the sole option of ClassForKids for a prize of equal or greater value.

2.3 All incidental expenses associated with collection of a Prize, are the responsibility of the Winner.

2.4 Each Winner of a Prize shall be solely responsible for any local taxes, that apply to their Prize. The Winners of the Prizes must provide ClassForKids with all information reasonably necessary to deliver the Prizes.

2.5 Each Prize is offered “as is” with no written, express, or implied warranty.

2.6 The Grand Prize winner shall make themselves available for approximately 10 hours, as determined by ClassForKids, in the period of March 1, 2024, to July 31, 2024, in order to receive consulting from the ClassForKids team. These dates are not exchangeable.

Winner Selection

3.1 ClassForKids will review the entries between February 29 and March 15, 2024.

Selection will be based on submitted contest entry forms and evaluated on the response to questions: 1. Why do you think your business should be selected to win this contest? And 2. What impact will winning have on your business and its goals?

3.2 The Contest winners (each, a “Winner”) will be selected on or around March 25, 2024. If any of the Winners do not claim a Prize within 72 hours, ClassForKids will be permitted to select a new Winner for said Prize without any compensation to the original Winner. All decisions of ClassForKids are final and binding in all respects. If a potential Winner is found not to be eligible or not in compliance with these Terms, if the Prize notification is returned as undeliverable, or if the Prize is rejected, the potential Winner may be disqualified and the Prize will be forfeited and may be awarded to an alternate Winner or cancelled, at ClassForKids’ sole discretion.

3.3 Instructions on claiming the Prize will be communicated to the Winner within 10 days of Winner verification. The odds of winning a Prize depend on the quality of entries received.

Proof of Age

4.1 Winners may be asked to provide ClassForKids with proof of date of birth, or parental consent in writing, before receiving their Prize.

Administration of the Contest

5.1 If for any reason the Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the reasonable control of ClassForKids which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, ClassForKids reserves the right at its sole discretion, to cancel, terminate, modify or suspend the Contest.

5.2 ClassForKids disclaims all responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, problem or technical malfunctions, technical problems or traffic congestion on the internet, through mobile apps or at any website, or any combination thereof, which may limit Contestants’ ability to participate in the Contest.

5.3 Where the Contest involves access or use of a third-party system or website (“Third Party Website”), Contestant understands and agrees that: (a) ClassForKids has no control over the Third Party Website whatsoever; (b) to the extent applicable, Contestant is solely and fully responsible for its use of the Third Party Website; and (c) ClassForKids disclaims any and all responsibility or liability for any harm resulting from Contestant’s use of any Third Party Website.

5.4 ClassForKids reserves the right in its sole discretion to disqualify, and seek any applicable legal remedies and damages from, any Contestant breaching these Terms or tampering with the entry process or the Contest in any way.

Release of Liability

6.1 By entering the Contest, each Contestant (including a Winner) hereby releases and saves ClassForKids, its affiliates and their respective directors, officers, employees, suppliers, sponsors, advisors and agents harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Contest; or resulting from acceptance, possession, or use of a Prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.

Contact

7.1 ClassForKids is collecting personal information about Contestants for the purpose of administering this Contest. If selected as a potential Winner in accordance with these Terms, ClassForKids will contact the potential Winner at the address provided to determine eligibility and for Prize administration purposes. Contestants may also continue to receive promotional communications from ClassForKids if currently subscribed to these communications. Contestants may opt-out of marketing communications sent by ClassForKids at any time by clicking on the unsubscribe link in the marketing email received. All personal information collected in connection with this Contest will be used in accordance with ClassForKids’s PRIVACY POLICY.

Publicity

8.1 A Winner, in accepting a Prize, consents to: (i) ClassForKids’ use of their name, business name and/or logo for purposes of advertising, trade and promotion in any and all media, without further compensation, except where prohibited by law, and (ii) assist and participate in ClassForKids’ media communications in connection with the Contest, which may include appearing in video promotions, providing quotes for press releases and posts on social channels.

Termination


ClassForKids reserves the right to amend or terminate all or any portion of this Contest at any time for any reason without prior notice.
